New Mexico Man Claiming To Have Virus Spits On Police, Then Claims It ‘Doesn’t Live In Summertime’

How many more ways can people be gross or inconsiderate during this pandemic?

The options seem to be endless, as the latest anti-masker spit at several cops, after claiming he had tested positive for the virus.

77-year-old Charles Madrid from New Mexico was shopping at Walmart’s Las Cruces location, when he was asked to put on a mask. Madrid refused and was told to leave the store.

When he was still unwilling to wear a mask or leave, several police officers arrived to remove him from the store.

In a video that has since gone viral, Madrid can be seen arguing with the police about his rights to stay in the store and his unwillingness to leave or put on a mask.

Madrid told them: 

“I’m not going to do it. Put me in jail.” 

One police officer, identified as Officer Jackson Brown, informed Madrid from off camera they would be forced to remove him from the store if he did not comply.

Madrid then threatened them:

“I’ve got the f**king virus. I’m going to spit in your face.” 

Madrid then repeatedly attempted to spit at the officers before being placed in handcuffs. The video cuts out for a moment, when Madrid ended up on the floor, refused to get up on his own and spit up at one of the officers.

After removing Madrid from the store, the officers arrested him and placed a spit guard over his face, after he attempted to spit at them several more times while in the parking lot.

Madrid then complained to the officers that his knees hurt from the altercation, so they transported him to a nearby hospital to make sure he was okay.

While on a hospital gurney, Madrid began to reassure the officers: 

“Don’t worry, you ain’t going to get that virus. It doesn’t live in the summertime. It dies out like the flu.” 

The officers sounded unconvinced before the video ended.

Since the altercation, Madrid has been charged with three counts of assault against a police officer for spitting at the police who arrived to remove him for trespassing.

Needless to say, many on Twitter have voiced their disgust with this man’s behavior. 


This is an unfortunate example of not only weaponizing a virus but also spreading inaccurate information.

Unfortunately, both of these behaviors appear to be prevalent among certain segments of the population as the rest of us continue to do our best to put this pandemic behind us with minimal deaths.
